1- El arrendatario y los conductores adicionales deberán ser mayores de 25 años y estar en posesión del permiso de conducir con una antigüedad superior a 1 año. Y se compromete a no permitir que otras personas no autorizadas por Marbrent conduzca el vehículo.
2- El arrendatario se compromete a mantener el vehículo cerrado cuando no se utilice.
3- El arrendatario no podrá ceder o vender el vehículo ni su equipo de herramientas. Cualquiera de estos hechos supondrá la retirada inmediata del vehículo por parte de Marbrent.
4- El arrendatario reconoce haber recibido el vehículo en perfectas condiciones y los cinco neumáticos y ruedas de respuesto en buen estado. En caso de pérdida o deterioro de alguno de ellos, el arrendatario se compromete a reemplazarlo inmediatamente por neumáticos o ruedas de idénticas características y estado de uso.
5- El cuentakilómetros como sus conexiones, no podrá manipularse, si así fuera, el arrendatario deberá abonar el alquiler como kilómetros ilimitados o 200 km por día, independientemente de las indemnizaciones que se correspondan a tal uso fraudulento. El exceso de kilómetros tendrá un coste de 0,30 € por Km.
6- El arrendatario será responsable de los gastos de la grúa y de los días de paralización del vehículo por accidente, avería o retención que se deban a la negligencia del conductor, así como las averías fuera del área de cobertura. Y se facturarán a razón de la tarifa vigente.
7- El arrendatario será responsable de las multas de tráfico, así como de los gastos por infracciones a la legislación vigente del Código de Circulación.
8- El vehículo solo podrá circular dentro de la región de Andalucía.
Los vehículos de Marbrent incluyen sin coste adicional el seguro obligatorio del automóvil complementario de responsabilidad civil por daños y perjuicios frente a terceros derivados del uso y circulación del vehículo y fianza con garantías ilimitadas. Por ello el arrendatario y cualquier conductor autorizado por Marbrent participa como asegurado de los beneficios de una Póliza de Seguros, aceptando los términos y condiciones de la misma.
Marbrent ofrece a todos los arrendatarios la posibilidad de proteger a los usuarios de la responsabilidad parcial o total del vehículo en caso de colisión, robo o actos vandálicos.
El cliente puede escoger entre contratar previamente un coste adicional por grupo o modelo según tarifa, las siguientes coberturas: CDW y Súper CDW: estas condiciones no son un seguro, es una cobertura que ofrece Marbrent. No son aplicables para menores de 29 años y mayores de 70 años.
Opción 1 - CDW. Exime al conductor parcialmente de la responsabilidad económica por los daños al vehículo en caso de colisión, robo (no de los objetos personales que deje el arrendatario en el interior del vehículo) o actos vandálicos. El usuario sólo será responsable parcialmente del pago de una cantidad no eximirle (franquicia).
Opción 2 - Súper CDW. Exime al arrendatario totalmente de la responsabilidad económica en caso de daños del vehículo por colisión.
Las coberturas CDW y Súper CDW, quedarán anuladas en los siguientes casos:
- Todos los accidentes que se deban a la negligencia del conductor. Por conducción temeraria, influencia del alcohol o drogas, exceso de velocidad, no respetar señales de tráfico (semáforos, stop, ceda el paso, rotondas, líneas continuas,...)
- Conducción por personas distintas a la que figura en el contrato de alquiler, rotura de embrague por mal uso, pérdidas de llaves, daños producidos.
El arrendatario se compromete expresamente a pagar al Arrendador todos los daños ocasionados por colisión, vuelco del vehículo debido a la negligencia del conductor. El conductor hará frente al coste total de los daños y paralización ocasionados al vehículos de Marbrent. Se cargarán contra su tarjeta de crédito que deja como depósito y previamente al arrendatario autorizó la firma de este contrato.
El arrendatario asumirá la responsabilidad total en caso que no haya contratado ninguna de las coberturas que ofrece Marbrent en el vehículo en los siguientes casos:
1- Todos los supuestos mencionados anteriormente y que anulan las coberturas CDW y Súper CDW.
2- Rotura de los cristales y lunas del vehículo producidas bien de forma fortuita o bien rotas para robar en el interior del vehículo los objetos que el arrendatario ha dejado.
3- Los daños que sufra el vehículo cuando se produzca por colisión, choque contra árboles, túneles, puentes, garajes, guarda railes, desniveles o mal estado de la calzada o caminos... en general contra cualquier otro objeto como consecuencia de una incorrecta apreciación de la conducta por parte del conductor.
4- Daños producidos en los bajos del vehículo.
El arrendatario está obligado a proteger los intereses del arrendador y de la compañía de seguros, en caso de accidente, durante el periodo de vigencia de este contrato, de la siguiente manera:
- Avisando inmediatamente a la policía y a la oficina de Marbrent.
- Obteniendo los nombres y direcciones de las personas involucradas en el accidente así como posibles testigos.
- No admitiendo nunca la responsabilidad ni culpabilidad.
- No abandonando el vehículo sin tomar las adecuadas medidas de protegerlo.
- Personándose dentro de las 24 horas siguientes en la oficina de Marbrent para entregar el parte del accidente cumplimentado e informar del mismo.
En caso de que el arrendatario no cumpliera con alguno de los requisitos anteriormente enumerados, siendo esto aplicables, Marbrent podrá reclamar al arrendatario daños y perjuicios ocasionados por la negligencia de éste, aún cuando hubiese aceptado la compra del CDW o Súper CDW que en tal caso quedaría sin efecto.
Marbrent no se hace responsable de los objetos transportados en el vehículo.
El contrato se dará por finalizado en la fecha fijada por el cliente. Si requiere una extensión, debe acordarla previamente y abonarla por adelantado. El incumplimiento de este requisito derivará en uso indebido del vehículo y suspensión del seguro.
Marbrent declina toda responsabilidad por daños a propiedades debidos a accidentes por el vehículo de alquiler, así como declina cualquier responsabilidad si deliberadamente el arrendatario ha suministrado a Marbrent información inexacta relativa a su identidad, domicilio o validez de su permiso de conducir.
La gasolina queda a cargo del arrendatario y debe devolver el tanque al mismo nivel que la entrega, en caso de que no sea así, se cargará 20€ más por el servicio. Además debe controlar los niveles de aceite y agua.
El desgaste mecánico normal del vehículo lo asume Marbrent.
El presente contrato se refiere y será interpretado de acuerdo con las leyes españolas vigentes. Cualquier cuestión será sometida a los Tribunales de Marbella o Málaga.
1- The hirer and any additional drivers must be over 25 years of age and be in possession of a driving license that had been held for more than a year. Both the hirer and additional drivers duly undertake not to permit any other persons not authorized by Marbrent to drive the vehicle.
2- The hirer undertakes to keep the vehicle locked when it is not in use.
3- The hirer cannot sell or transfer the vehicle, or its kit of tools. Failure to comply with this shall result in the immediate repossession of the vehicle by Marbrent.
4- The hirer acknowledges that he or she has received the vehicle in perfect condition, with its five tires and wheels in good order. In the event of loss or deterioration of any of these, the hirer undertakes to immediatlely replace same, always with tires or wheels of identical characteristics and state of use.
5- The odometer and their connections, you cannot handle, if so, the tenant must pay rent or unlimited kilometres of 200 km, per day regardless of the allowances that correspond to such fraudulent use. Excess mileage cost 0,30€ per km.
6- The hirer shall be responsible for the expenses of the tow away truck ad for the days of non-availability of the vehicle as a result of accident, breakdown or retention, in the event of these being the result of negligence on the part of the driver, likewise, breakdowns, outside the area of coverage. All this shall be invoiced at the current tariff.
7- The hirer shall be responsible for traffic fines, likewise any expenses corresponding to infractors of the current legislation in respect of the Road Traffic Act.
8- The vehicle can only be driven within the region of Andalucia.
Marbrent includes, at no extra cost, in the vehicle rental price, the obligatory motor insurance, the cover in respect of civil liability for damage to third parties as a result of use and circulation of the vehicle and surety with unlimited guaranties. For this, the hirer and any driver authorized by Marbrent shall participate as the insured party in the benefits of a Motor Insurance Policy, accepting the terms and the conditions thereof.
Marbrent offers all its clients the possibility of protection of its use from the total or partial liability of the vehicle in the event of collision, theft or acts of vandalism.
The client can contract in advance at an additional cost, according to group or model, one of the following types of cover: CDW (Collision Damage Waiver) or Super CDW. These options are not insurance policy, but represent cover offered by Marbrent. They are not applicable to persons under 29 years of age or persons over 70 years of age.
Option 1 - CDW: This partially exempts the driver from financial liability in the event of collision, theft (not of personal items left in the vehicle by the hirer) or acts of vandalism. The user shall only be partially responsible for payment of a sum (excess).
Option 2 - Super CDW: This totally exempts the driver from financial liability in the event of damage to the vehicle through collision, theft of acts of vandalism.
The CDW and Super CDW cover shall be annulled the following circumstances:
1- All accidents due to neglegence n the part of the driver. As a result of dangerours driving, being under the influence of alcohol, drugs, speeding.
2- Falling to respect traffic signs (traffic lights, stop and give way signs, roundabouts, continuous lines, etc).
3- The vehicle being driven by a person other than those shown in the rental contract.
4- Failure of clutch through misure thereof.
5- Loss of key.
6- Damage to the vehicle interior such as burns or breakage of the seats, or any other damage caused by the user.
The hirer undertakes to pay the renting company for all damage occasioned by collision or turning over of the vehicle owing to negligence on the part of the driver. The driver shall meet the total cost of the damage and stppage occasioned to the Marbrent vehicle. The cost shall be charged to the credit cart let as deposit.
The hirer shall assume full liability in the event of not having contracted any of the cover offered by Marbrent, in the following ciruamstances:
1- All the circumstances mentioned above, which annul the CDW and Super CDW.
2- Breakage of the vehicle´s windscreen and windows occuring either fortuitously of the result of the theft from the interior of the vehicle of items that the hirer had left there.
3- Damage suffered by the vehicle when same be the result of collision or impact against trees, tunnels, bridges, garages, guardrails, unevenness or poor condition of the road surface or street or, in general, against any other object, as a consequence of a driving error on the part of the driver.
4- Damage occasioned to the undermeath of the vehicle.
The hirer is obliged to protect the interests of the rental company and of the insurance company in the event of a an accidente during the period of validity of this contract, in the following manner:
- Immediately informing the Police and offices of Marbrent.
- Obtaining, the same and addresses of the persons involved in the accident, likewise of possible witnesses.
- Never admitting either responsibility or guilt.
- Not abandoning the vehicle without taking adequate steps to protect same.
- Visiting Marbrent offices within the following 24 hours t hand over the duly completed accident report and to inform the same.
In the event of the hirer falling to comply with any of the requirements indicated above, should the be applicable, Marbrent could claim from said hirer for damage occasioned be the negligence of the latter, even though he or she had accepted the purchase of the CDW or Super CDW, which, in such case, would be rendered invalid.
Marbrent undertakes no liability for items transported in the vehicle.
The contract shall terminate on the date established by the client. If an extension is required, this must be agreed beforehand and paid in advance. Failure to comply with this requirement shall consitute improper use of the vehicle and suspension of the insurance.
Marbrent declines all liability for damage to property owing to an accident involving the rented vehicle, likewise declining all liability if the hirer has deliberately supplied Marbrent with incorrect information as to his or her indentity, address, or validity of driving license.
Petrol is at hte hirer´s expense. Vehicles must be returned with the petrol tank at the same level as when it was handed over. Should this not be the case, Marbrent will charge the hirer for the missing petrol at the preaviling price, plus 20€ to be applied for the service. The hirer must also monitor the levels of oil and water.
The normal mechanical wear and tear of the vehicle is assumed by Marbrent.
The present conract refers to and shall be interpreted in accordance with current Spanish Law. For any dispute derived from the interpretation of compliance with the stipulations of same both parties subject themselves to the Courts of Marbella or Málaga.
